The AAP national convener, who was arrested by the ED on 21st March, could have been walking out of Tihar jail on 21st June had it not been for the High Court's decision to grant an interim stay relief to the federal anti-money laundering agency.

The trial Court stated in its bail order that Mr. Kejriwal had established no guilt at all and that ED had no direct evidence to connect him to the proceeds under the money laundering case. Special Judge Niyah Bindu added that there was a bias on the part of the central agency against the AAP supremo.

ED arrested chief minister in Delhi on March 21, claiming that Mr. Kejriwal was the ‘kingpin’ in the Delhi Excise Policy scam. After weeks in custody, he was released by the Supreme Court on May 10 to campaign for Lok Sabha elections and went back to prison on June 2 because the Supreme Court refused to give him any more relief.

The AAP chief had filed a petition in the top court challenging the Delhi High Court's pause on the bail granted to him by a lower court last week. While pausing the bail, the court said it would pronounce its order on June 25.A bench comprising Justices Manoj Misra and SV Bhatti presided over the proceedings, where senior advocates Abhishek Manu Singhvi and Vikram Chaudhary represented Kejriwal, and Additional Solicitor General (ASG) Raju appeared for the Enforcement Directorate (ED).

 

At this, Justice Misra responded, "If the High Court has committed a mistake, should we repeat it?"

"If the High Court can stay it without seeing the order, why can't your lordships stay the High Court order" he argued.

The bench further questioned the urgency, asking why waiting for a day would be problematic. Senior advocate Vikram Chaudhary referred to the Supreme Court's May 10 order granting Kejriwal interim bail and noted the court's observations that Kejriwal, as the Chief Minister of Delhi, had no criminal antecedents, posed no threat to the investigation, and had only been arrested in March 2024, despite the investigation being ongoing since August 2022.

Adjourning the hearing, the bench said if the High Court's order is passed in the meantime, it can be brought on record. Kejriwal's plea will be taken up again on Wednesday, June 26"
